King of Diamonds Customer Arrested after Test Refusal
A King of Diamonds employee called police after a man, who appeared drunk, refused a cab ride home and started to drive away.
After a night of drinking at a 51-year-old Punta Gorda, Fla., man was arrested after refusing a DWI test.
were called to the club around 11:19 p.m. on Jan. 4 by an employee who watched a customer try to drive away intoxicated.
According to the report: the employee had urged the man to take a cab home, but the customer refused. He got into his car, with Minnesota plates, and began to back out of the parking spot. When he apparently noticed the King of Diamonds employee watching him he pulled back into the stall.

Police arrived and found the man in the driver’s seat of his car and smelling of alcohol on his breath. Though the man denied drinking, his conversation with the police officers was with slurred speech and waning attention. He did say the Florida address was correct.
Officers eventually asked the man to take some field sobriety tests.

“He was having trouble getting his feet out of the car and onto the ground,” the officer wrote in the report.
The man failed the nystagmus test when his whole head turned rather than just his eyes to follow the officer’s finger. He then refused to stand on one foot and give a preliminary breath sample.
He was taken into custody and again refused a test to determine his blood-alcohol content and would not talk other than to say he wanted an attorney.
